Suggestions on How to Claim a Medical Exemption in California (Full Report)
As you probably know, SB 277 was signed by Governor Brown in late June 2015.
IMPORTANT!!! YOU MUST FILE A PERSONAL BELIEF EXEMPTION (PBE) BEFORE YEAR-END 2015. Parents do not have to sign the PBE form if they are not comfortable with the language. Parents can attach the unsigned form to their own letter SB-277 Public health: vaccinations per SEC. 2. 120335. (b) (11) (g)
(1) A pupil who, prior to January 1, 2016, submitted a letter or affidavit on file at a private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center stating beliefs opposed to immunization shall be allowed enrollment to any private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center within the state until the pupil enrolls in the next grade span.
(2) For purposes of this subdivision, “grade span” means each of the following:
(A) Birth to preschool.
(B) Kindergarten and grades 1 to 6, inclusive, including transitional kindergarten.
(C) Grades 7 to 12, inclusive.”
It is recommended that parents have their letter notarized. Ask the school to provide you a receipt of the unsigned PBE form attached to your letter by placing their date stamp and signature. Keep a copy for your records. It is recommended that IEP students also file a PBE to insure classroom inclusion. Filing a PBE or letter will help protect your children form any new vaccines added to the mandatory list during the ‘grandfather” grade span. A sample letter can be found here You can find the personal belief exemption form here
YOU MUST SUBMIT a PBE form or letter to the private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center BEFORE YEAR-END 2015 FOR IT TO BE VALID.
Requirements of SB 277:
Beginning July 1, 2016, if your child will be enrolling in any school/preschool/daycare for the first time or moving up a “grade span” (grade spans are birth to preschool, kindergarten to grade 6 inclusive, and grade 7-12 inclusive), you will need to either home school your kids or obtain a medical exemption if you do not want to vaccinate them. If your child has an Individualized Education Program (IEP) they may also remain in school unvaccinated as Federal law protects access to a public education for those with IEPs. Children as young as 3 may obtain IEPs.
Vaccines required by SB 277 for daycare or preschool are:
4 DTaP, 3 Polio, 3 Hep B, 1 Hib for infants 15 months or older), 1 MMR, 1 Chicken pox.
Vaccines required for kindergarten entry in a previously unvaccinated child:
4 DTaP, 3 Polio, 3 Hep B, 1 HIB, 2 MMR, 2 Chicken pox. (Notes: For children already 5 no Hib vaccine is required as Hib is only FDA approved for use before 5 years of age; most children will develop antibodies after only 1 dose of MMR and chicken pox so titers can determine this.)
Vaccines required for children 7-11 years old in a previously unvaccinated child:
1 TDaP*, 3 Hep B, 3 Polio, 1 MMR, 1 Chicken pox. (Children 7 and older cannot receive DTaP but must receive TDaP which is single dose.)
Vaccines required in children 12 and older, previously unvaccinated:
1 Tdap, 3 Polio, 1 MMR, 1 Chicken pox.
Following is the text of the legislation referring to medical exemptions:
(a) If the parent or guardian files with the governing authority a written statement by a licensed physician to the effect that the physical condition of the child is such, or medical circumstances relating to the child are such, that immunization is not considered safe, indicating the specific nature and probable duration of the medical condition or circumstances, including, but not limited to, family medical history, for which the physician does not recommend immunization, that child shall be exempt from the requirements of Chapter 1.
(Please note that although the law uses the term “immunization” the accurate term should be “vaccination” because vaccines do not truly yield immunity. Vaccines are said to be effective as long as they elicit an antibody response but presence of antibodies does not mean an individual is immune. Vaccinated individuals can have antibodies to diseases but not be immune and vaccinated individuals can have zero antibodies but be immune.)
As you can read in the text of the bill, medical exemptions can be given according to the physician’s discretion.
Below are suggestions and resources for how you can find a physician who understands vaccine risks, tests you can have done to demonstrate that your child is at risk, and information to educate a physician as to why your child qualifies for a medical exemption – given the toxins and adventitious ingredients in vaccines, ALL individuals should qualify.
1) Please refer to this very useful compilation of links or this link to find physicians who understand vaccine risks. Also, remember that pediatricians are likely to be the most dogmatic regarding vaccines whereas family physicians may be less so. The physicians at the links above already respect different approaches to vaccines so may be more likely to write a medical exemption. In general, physicians likely to be most helpful are those who are qualified in functional medicine or integrative medicine. To find a functional medicine physician, use this link. To find an integrative medicine physician check this link or this link or search for “find an integrative medical doctor and search one of the other organizations. When using these lists of doctors, please note that only medical doctors (MDs and DOs) may write medical exemptions, not DCs or NDs, etc. Also, bear in mind that most pediatricians and general medical doctors do not use and may not understand the tests and suggestions below so it would be wise to work with one of the physicians at the links given.
2) Disabilities: More and more research is showing that individuals with a variety of conditions and genetic mutations are more susceptible to vaccine reactions.
These conditions and disabilities include already existing or a family history of previous vaccine reaction, eczema, food and environmental allergies, asthma, gut issues such as Crohn’s and IBS, autoimmune disease such as diabetes, lupus, MS, rheumatoid arthritis, ASIA, and others, chronic ear, sinus, strep or other infections, Lyme disease, PANDAS, POTS, learning disabilities, speech delay, ADD, ADHD, autism, seizures, bipolar, schizophrenia, thrombocytopenia, genetic variance, impaired methylation, detoxification impairment, and more.
Ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
3) Conduct genetic testing prior to vaccinating to better understand your child’s risk.
Test for various disabilities, conditions, and genetic variance such as variation in MTHFR, CBS, COMT, all BHMTs, MAO-A, SOD, cytochrome p450 enzymes, and HLA type which can determine your child’s susceptibility to vaccine injury.
Inexpensive salivary genetic testing can be done through 23andMe and interpretive data can be uploaded through http://www.geneticgenie.com. The cost is $99 for the saliva kit and $79 for additional kits ordered at the same time; plus about $10-30 for the interpretive profile, depending upon which site is used. Follow up with a visit with a skilled health care practitioner to better understand genetic mutations. Pay careful attention to mutations of MTHFR, CBS, all BHMTs and MAO-A.
Another option is the NeuroGenomic test from Genova Diagnostics to evaluate variations in genes that modulate methylation, glutathione conjugation, oxidative protection and the potential to evaluate vascular oxidation. You can also find a doctor who conducts and interprets these tests on their website here.
Make sure your physician sees the results of your child’s genetic testing. Ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
4) Conduct allergy and reactivity to tests for ingredients in vaccines.
ELISA, or EIA, is an acronym for enzyme-linked immunoassay. ELISA is a test that detects and measures antibodies in your blood. This test can be used to determine if you have reactions to different substances such as those contained in vaccines. ELISA tests for aluminum, mercury, polysorbate 80, formaldehyde, MSG, (what other components of vaccines) should be conducted to determine a person’s reactivity to those substances.
According to CDC, vaccines contain aluminum, antibiotics, egg protein, formaldehyde, MSG, thimerosal, and many other potentially toxic ingredients including foreign proteins. CDC states explicitly, “For children with a prior history of allergic reactions to any of these substances in vaccines, parents should consult their child’s healthcare provider before vaccination.”
Explain to your physician that you are consulting with them as outlined by SB 277 but do not want to take the chance that your child has either an immediate or a delayed allergic reaction to any of the ingredients in the vaccines.
Ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
5) Test antibody levels to all required vaccines. The law that SB 277 amended allowed titer tests to demonstrate antibody levels – thought to be a marker for immunity – in lieu of repeated vaccination. While it is now understood scientifically that antibodies do not mean an individual is immune, they are still accepted as evidence of such. Titers will be needed at each grade span change. Your doctor can conduct titer tests or the tests can be ordered online. Simply enter “titer tests” in your search engine to find labs near you or have tests sent.
Ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
6) Scientific literature concerning medical risks of vaccines:
According to the Institute of Medicine report Adverse Effects of Vaccines: Evidence and Causality ( 2012 ),
“Both epidemiologic and mechanistic research suggest that most individuals who experience an adverse reaction to vaccines have a preexisting susceptibility. These predispositions can exist for a number of reasons — genetic variants (in human or microbiome DNA), environmental exposures, behaviors, intervening illness, or developmental stage, to name just a few— all of which can interact as suggested graphically in Figure 3-1.
Some of these adverse reactions are specific to the particular vaccine, while others may not be. Some of these predispositions may be detectable prior to the administration of vaccine; others, at least with current technology and practice, are not. Moreover, the occurrence of the adverse event is often the first sign of the underlying condition that confers susceptibility.”
Ask the doctor administering the vaccine(s) to sign a medical exemption in light of statements by the US Institute of Medicine that vaccination may reveal a susceptibility for the first time. If he/she will not do so, find another doctor. The doctor can use this report – directly from the US Institute of Medicine, to defend that position.
Aluminum Dangers
Aluminum experts have stated that aluminum has no biological use or need and is toxic to all life forms. According to renowned aluminum expert Chris Exley of Keele University,
“the combined adjuvanticity and antigenicity of aluminium probably means that we are all ‘allergic’ to aluminium exposure it is simply that in some individuals the response can be significantly more severe. It is knowing which individuals might show the most acute response which eludes us at present.”
See Exley’s papers:
1) The immunobiology of aluminium adjuvants: how do they really work?,
2) A role for the body burden of aluminium in vaccine-associated macrophagicmyofasciitis and chronic fatigue syndrome,
3) Aluminium adjuvants and adverse events insub-cutaneous allergy immunotherapy
4) Aluminium in Medicine
In “Aluminum vaccine adjuvants: are they safe?” Lucija Tomljenovic and Christopher Shaw state:
“Aluminum is an experimentally demonstrated neurotoxin and the most commonly used vaccine adjuvant. Despite almost 90 years of widespread use of aluminum adjuvants, medical science’s understanding about their mechanisms of action is still remarkably poor. There is also a concerning scarcity of data on toxicology and pharmacokinetics of these compounds. In spite of this, the notion that aluminum in vaccines is safe appears to be widely accepted. Experimental research, however, clearly shows that aluminum adjuvants have a potential to induce serious immunological disorders in humans. In particular, aluminum in adjuvant form carries a risk for autoimmunity, long-term brain inflammation and associated neurological complications and may thus have profound and widespread adverse health consequences. In our opinion, the possibility that vaccine benefits may have been overrated and the risk of potential adverse effects underestimated, has not been rigorously evaluated in the medical and scientific community.”
As aluminum has no biological use or need, is toxic to all life, is likely an allergen to us all, and most importantly has not been properly studied, ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
Dangers of Thimerosal (ethylmercury)
43 studies on thimerosal (http://www.greenmedinfo.com/toxic-ingredient/thimerosal) indicate at least 30 different adverse effects including: neurodevelopmental disorders, autism spectrum disorders, autism, tic disorders, vaccine-induced toxicity, learning disorders, attention deficit disorder, mental retardation, speech disorders, mercury poisoning, childhood chemical exposures, cognitive decline/dysfunction, emotional disorders, infantile spasms, seizures, sexual developmental dysfunction and abnormalities, oxidative stress, mitochondrial dysfunction, attention deficit disorder with hyperactivity, developmental disorder, ataxia, atopic diseases, impaired detoxification, borderline personality disorder, neurodegenerative diseases, excitotoxicity, amygdala damage/abnormalities, autoimmune diseases, neurotoxicity, DNA damage, immune disorders/low immunity.
This science is also available as a PDF to download here:
http://www.greenmedinfo.com/sites/default/files/gpub_55003_toxic_ingredient_thimerosal.pdf
As thimerosal is a proven neurotoxin, ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
Autoimmune Disease
Vaccines are an acknowledged cause of a variety of autoimmune diseases including, but not limited to: 1) MS and demyelinating diseases, 2) rheumatic disease, 3) asthma, 4) allergy, 5) Autoimmune/inflammatory syndrome induced by adjuvants (ASIA), 6) Macrophagic myofasciitis, 7) Immune dysregulation.
See respective studies at links below:
1) Recombinant hepatitis B vaccine and the risk of multiple sclerosis: a prospective study
2) Chronic Arthritis after Rubella Vaccination
3) Infection of human B lymphocytes with MMR vaccine induces IgE class switching
4) Delay in diphtheria, pertussis, tetanus vaccination is associated with a reduced risk of childhood asthma
5) ASIA: A New Way to Put the Puzzle Together
6) Macrophagic myofasciitis: characterization and pathophysiology
7) Vaccines and autoimmunity
As vaccines are proved to cause autoimmune diseases, ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
Dangers of Injecting Foreign DNA
Many vaccines are made with DNA from humans and other species including monkeys, mice, bovines, and chickens and vaccines also contain DNA fragments of viruses. The safety of this foreign DNA has not been established but viruses and fragments of viruses have been found in a variety of vaccines such as Rotavirus vaccines, HPV vaccines, and more. In Death after Quadrivalent Human Papillomavirus (HPV) Vaccination: Causal or Coincidental?, researchers found fragments of the vaccine-strain of HPV-16 in the brains of two deceased young women as well as antibodies to these fragments suggestive of an autoimmune reaction. Moreover, scientists believe the cause of autism may lie in the increased use of cells from human fetal tissues and the accompanying human DNA contaminating those vaccines. See Theoretical aspects of autism: Causes—A review from former pharmaceutical scientist, Helen Ratajczak and CBS News’ report:
http://www.cbsnews.com/news/vaccines-and-autism-a-new-scientific-review/
As vaccines are acknowledged to contain foreign DNA contamination and this foreign DNA is linked to autoimmune disease and death, ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
MSG Dangers
Although CDC states that MSG acts as a stabilizer in vaccines “to help the vaccine remain unchanged when the vaccine is exposed to heat, light, acidity or humidity,” according to other sources, it is a food additive that is used to enhance the taste of food. Additionally, MSG is recognized as a toxin to brain cells by overexciting them which results in damage to them or death and causes brain damage. Although FDA claims MSG is safe to eat, it also recognizes these short term reactions to MSG:
• Numbness
• Burning sensation
• Tingling
• Facial pressure or tightness
• Chest pain or difficulty breathing
• Headache
• Nausea
• Rapid heartbeat
• Drowsiness
• Weakness (Source)
Given the impact MSG has on the brain and FDA’s acknowledgement that it can have a variety of side effects when eaten, it is hard to understand how MSG can be deemed safe to inject, especially to babies and children. Ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
Formaldehyde Dangers
From the National Cancer Institute: The International Agency for Research on Cancer (IARC) classifies formaldehyde as a human carcinogen. In 2011, the National Toxicology Program, an interagency program of the Department of Health and Human Services, named formaldehyde as a known human carcinogen in its 12th Report on Carcinogens.
IARC Monographs on the Evaluation of Carcinogenic Risks to Humans Volume 88 (2006): Formaldehyde
National Toxicology Program (June 2011). Report on Carcinogens, Twelfth Edition
While many vaccine proponents claim the amount of formaldehyde in vaccines is nothing to worry about a deeper analysis tells another story. Many childhood vaccines contain formaldehyde including almost all pediatric flu vaccines; all pediatric and adolescent pertussis vaccines (DTaP and TDaP); and injectable polio vaccines (IPV) vaccines.” According to Dr. Tenpenny, if a child gets all the doses of vaccines on the recommended schedule for 2012, the amount of formaldehyde that will be injected into their little bodies and developing brains is:
• Hepatitis b – 3 doses x 15 mcg each
• DTaP – 5 doses x 100 mcg each
• Polio (IPV) – 5 doses x 200 mcg each
• Influenza – 6 doses x 25 mcg each
• Hepatitis A – 1 dose x 100 mcg each
Total: 1,795 mcg = 1.795 milligrams
This is by no means an insignificant amount when the mere inhalation of formaldehyde is enough to cause nasal cancer in rats. Some argue that our bodies produce more formaldehyde than what is injected and/or that we can safely eat more than that injected – but the formaldehyde in vaccines is injected, not created by our bodies and this formaldehyde is injected, not eaten. Toxic exposures from eating are not comparable to exposures from injection.
The purpose of formaldehyde in vaccines is to kill and/or inactivate antigens in the vaccines and while FDA states there is no risk from this formaldehyde, the fact that formaldehyde is there to kill belies the purported safety.
Given the proven carcinogenicity of formaldehyde, the quantities in vaccines and the potential risks of injecting formaldehyde, ask the doctor administering the vaccine(s) to sign a medical exemption. If he/she will not do so, find another doctor.
Summary
As recognized by law, vaccines injure and kill – they are neither medically safe nor healthy. As recognized by federal health authorities, the first time a patient notices or experiences an adverse reaction may be the first time a vaccine is given. It is important to note however that just because no noticeable reaction has occurred after a vaccine in the past, this is no guarantee that a future vaccine reaction will not occur after other vaccines have been administered. As your child’s immune system, nervous system, digestive system and blood brain barriers are not fully developed, injecting known immune and neurotoxins as well as carcinogens and other adventitious agents is not medically safe or healthy. If you cannot obtain a medical exemption, ask the physician to sign a written statement guaranteeing that neither a current vaccine he or she intends to give nor any future vaccine he or she intends to give will harm your child and that he or she will take full financial responsibility if the vaccine causes harm. The Physician’s Warranty of Vaccine Safety is one option.
For another comprehensive discussion of why every person should be entitled to a medical exemption see Laura Hayes’ Open Letter to CA Legislators and Governor Jerry Brown RE SB277.
If you absolutely must vaccinate, you can protect your children with the following guidelines:
• Wait until the child is at least two years old.
• Give no more than one vaccination at a time.
• Never vaccinate when the child is sick.
• Be sure that the vaccines are thimerosal-free, containing not a “trace amount”.
• Supplement the child with extra cod liver oil, vitamin C and B12 before and after each shot.
• Put your child to bed and keep him quiet for at least 24 hours after a shot.
• Obtain a medical exemption if the child has had a bad reaction to a vaccination before or if there is a personal or family history of vaccine reactions, convulsions or neurological disorders, severe allergies and/or immune system disorders.
Alternatively, consult with a homeopath who can help to protect the child before vaccination and address the impact of any vaccines given.
The above information is not to be construed as medical advice.

I highly recommend having children receive some kind of therapy that lowers fight-or-flight (sympathetic nervous tone) in the body after vaccination.
Why do something to balance the involuntary nervous system? Because the immune system works much better when we are not under stress and the child is less likely to “short circuit” and react badly following a vaccination. The body in parasympathetic tone (restorative tone, the opposite of fight or flight) can do a better job of many functions that the body doesn’t prioritize when we are “running from the lion.” These things include rest, digest, heal, and feel emotions. None of this matters if we don’t survive, so the body does not focus on it when we are stressed. Reproduction is not priority when in survival mode, which is why women who are under a lot of stress have so many more hormone and fertility problems than women who don’t. This mechanism also makes it clear why our bellies aren’t happy when we’re stressed. I find it odd when stressed people take a lot of oral supplements that their bodies can’t digest (vs meditate, exercise, play, spend time in nature, or seek a de-stressing therapy).
This entire point was driven home for me last week when one of my current families explained to me that the ONE TIME they did not bring their child for treatment after a vaccination a few months ago, her arm swelled up and she has been wetting the bed ever since (a symptom associated with excess fight-or-flight). They did not realize how abnormal this was, and they did not even know there was a reporting system for such a thing. We are now planning to avoid future vaccinations for this child as we believe her nervous system has now been shocked and response to future vaccination is unlikely to go well.
A treatment that balances the autonomic nervous system could be cranial osteopathy (performed by a physician DO who specializes in this), or a non-physician DO, or cranio-sacral therapist. Acupuncture works well for adults but children needless to say are not often receptive to needles. Acupressure or tuning forks on acupuncture points can work. I personally cannot take new children patients at this time but cranialacademy.org provides a physician finder for all states in the US.

Do you provide Medical exemptions? You are qualified to, and evidence supports that such an act could be in the best interests of the patient. It also sounds like you still use hands on manipulation. . .good for you! Few DOs act more than an MD. Also, I want to add to my comment above about treatment that supports the body should you choose to vaccinate. I provided this information for those who opt to vaccinate for whatever reason. This was not a statement supporting vaccination.

Hello, you seem to be well informed in this area so I have a question for you… I am wondering if my three kids would be a good candidate for vac exemptions. My older boys 10 and 12 both had most of their vacs as babies with some effects. Redness, swelling, inconsolable crying, one had his bed alarm go off at 4 and 6 months the night after vacs. I started researching vac ingredients and side effects and decided not to continue with vac. When my older son was 8 he got two vaccines which resulted in bed wetting and tics for the next three years. have not vac my four year old and she is by far my healthiest child! No ear infections, a few colds but that’s it in four years. We have a family history of:
lupus x2, aunt and grandparent
Kids have eczema,
Guillain Barré Syndrome X1 cousin after flu shot
celiac x1 aunt
Son got hives after antibiotics
psoriasis x 2
heart disease x3
breast cancer x 3
colon cancer x 2
pancreatic cancer grandparent
Liver cancer aunt
diabetes both grandparents
Colin cancer x3 my dad, his sis and his mom
ahlztimers
Those are the ones I am aware of!
I am really concerned with the vacs my kids have already received and now with sb277 i am extremely worried that I will be forced out of my home state! If I cannot get an exemption I willneed to move out of state. So I want to get prepared and start looking for teaching jobs. One will be going Into k, my fourth grdader is ok for two more years and then I have a 6th grader. So two are entering a new span. Any info you have would be awesome. Thanks! Feel free to email me also.

I have to add that, after reading some research, I believe that iron deficiency plays a major role in aluminum toxicity. Individuals with iron deficiency at the time of vaccination are more susceptible to aluminum toxicity which does cause encephalopathy. The aluminum competes with iron to bond with transferrin, therefore it will attach to transferrin and become absorbed by the body and not depleted. I would make sure your child has plenty of iron and is in the higher range of acceptable. In fact, the study showed that mice with high levels of iron had no adverse affects from aluminum being injected into them. I wouldn’t recommend having high iron (I am no doctor or scientist and I wouldn’t know if there could be another problem or synergistic effect related to the other contaminants in vaccines) , but you can see how important iron deficiency is to toxicity. So make sure your child is not low in iron at the time of vaccinations.

You’ve provided a good deal of valuable information about medical exemptions, adverse effects of vaccines, etc. – thank you!
However, some of your information about SB277 and its requirements is incorrect. Please note:
1. A PBE, or SB277-compliant exemption letter or affidavit, applies only to vaccines on the current “required” list; it has nothing to do with vaccines which may be added to the “required” list in the future. According to Section 120338 of the CA Health and Safety Code (as changed by SB277), both medical exemptions and personal belief exemptions must be allowed for any vaccines added to the “required” list in the future. When vaccines are added, no doubt new PBE forms will be created by the state department of health and made available through schools.
2. A PBE, or SB277-compliant exemption letter or affidavit, submitted on or before Dec. 31, 2015 will be valid until the end of the child’s grade span even if the child switches to a different institution (day care, preschool, public school, private school, etc.) — as long as the new institution is in the state of CA. This is stated in Section 120335(g)(1). For a school age child, the exemption document will be transferred to the new school as part of the child’s cumulative record. For day care/preschool kids, parents should ask the institutions how the exemption document will be transferred. When submitting a PBE or exemption letter/affidavit, a parent should request a photocopy of the document with “proof of receipt” added by the institution (e.g., a date-received stamp plus initials or signature of school employee).
3. A parent who chooses not to comply with vaccine requirements has three options: (1) obtain a medical exemption for the child; (2) homeschool the child; (3) enroll the child in an independent study program administered by a public or private school (and the independent study program may NOT include classroom instruction at the school). This is covered in Section 120335(f).
4. A child with an IEP must be allowed access to “any special education and related services required by his or her individualized education program.” The parent of an unvaccinated child with an IEP should review the child’s IEP to be sure that all school activities (including regular classes in which the child is mainstreamed) are listed in the child’s IEP.
There has been considerable confusion about the content of SB277, perhaps because the bill was amended nine times before being approved by the legislature and signed by the governor. Please correct the information in your article so that your readers come away with a clear and accurate understanding of the law.
Californians for Vaccine Choice says
To expand on the additional information Kayla so graciously shared, we would like to fine tune a couple of points:
1. “When vaccines are added, no doubt new PBE forms will be created by the state department of health and made available through schools.”
Unfortunately many school staff members are uninformed or are instructed to deliberately mislead parents regarding PBE options. Even though school nurses are authorised to sign off on the PBE form (saving families additional cost and time to schedule office visits) they most often refuse to do so. This may be due to the schools being incented to maintain high vaccination rates.
To assume that the schools will advise parents of future PBE options or that the language will not be self incriminating like it is now is a risk informed parents are not willing to take. This is very troublesome since schools are authorised to administer vaccines at school. Special needs children are extremely vulnerable, especially those who are nonverbal and will not be able to tell their parents what happened to them. Parents would not know to be on the lookout for any adverse reactions or seek appropriate treatment if needed. Special needs children deserve an extra layer of protection from the onslaught of over 270 new vaccines being fast tracked in the FDA approval pipeline.
4) An IEP is open for interpretation. It will not insure inclusion in the classroom setting because the IDEA guidelines have been/are being changed via Federal Education Code. It is best to file a letter before January 1, 2016 to insure special needs children are not subject to unauthorised vaccinations at school. Many parents also file this letter with their legal counsel.
The use of the term “SB277-compliant exemption letter” is a bit misleading since there are no limitations what a parent can state in their letter. therefore, all future vaccines added to the state mandate can be included. The only requirement when submitting a letter instead of the unsigned PBE form is that the unsigned form be attached. We recommend that parents have their letter notarized before submitting it to the school and retain a received date stamped copy that includes the full signature of the school’s authorised representative.
A sample letter can be found here: http://www.educateadvocateca.com/health-and-medical
Liliana De La Torre says
Hello and Thank you for all this great information. So, this SB277-compliant exemption form is only for children entering either daycare or an educational institute, correct? It was my understanding this the form needed to be submitted before the end of the year to protect children in the future. My unvaccinated son is only 2 years old. So, as I understand now after reading further I should have this form signed when he is ready to go into Pre-school or Kindergarten.
Thank you in advance for your input.
Californians for Vaccine Choice says
The “grandfather clause” is for children either currently enrolled or scheduled to start before July 1, 2016. You would need your enrollment application including your PBE letter or form on file with the daycare/preschool/school no later than December 31, 2015.
SEC. 2. Section 120335 of the Health and Safety Code is amended to read:
120335.
(11) (g) (1) A pupil who, prior to January 1, 2016, submitted a letter or affidavit on file at a private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center stating beliefs opposed to immunization shall be allowed enrollment to any private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center within the state until the pupil enrolls in the next grade span.
(2) For purposes of this subdivision, “grade span” means each of the following:
(A) Birth to preschool.
(B) Kindergarten and grades 1 to 6, inclusive, including transitional kindergarten.
(C) Grades 7 to 12, inclusive.

Where are you to submit the personal belief form to? The school? Do you think schools will accept forms that early for a child that’s not enrolling until June 2016? Thanks!
Californians for Vaccine Choice says
You submit your PBE letter or form to the attending school along with your enrollment packet no later than December 31, 2015. The attendance start date must be before July 1, 2016.
Jameese says
I apologize for possible stupid question; however, who do I submit the form to? Do I just get the form notarize and provided to the school and any future schools he is applying to?

Logicaldad says
All exemption forms go to the school to be placed into your child’s folder. It is never looked at again unless the state would audit the school. The school does have to provide vaccination statistics to the state, but that’s where it ends. For those who need a medical exemption, it’s important to realize that it’s not going to be that difficult to get. but there may be some hoops to jump through.
wu says
My question is if you already have a medical exemption letter on file before Jan1st.2016 from your doctor when you are in the 6 grade, do you need to submit a new medical exemption in 2016 to enter
the 7th grade?

Thank you for the Physician’s Warranty of Vaccine Safety template. I will be discussing this matter with my child’s pediatrician. Do you happen to have a medical exemption template? The state website does not provide one.
I don’t trust my writing skills, and I don’t want to give my pediatrician any reasons to deny my request.
Below is what Shotsforschool.org states:
Medical Exemptions
17. What’s required for a medical exemption to a required immunization?
A parent or guardian must submit a written statement from a licensed physician (M.D. or D.O.) which states:
• That the physical condition or medical circumstances of the child are such that the required immunization(s) is not indicated.
• Which vaccines are being exempted.
• Whether the medical exemption is permanent or temporary.
• The expiration date, if the exemption is temporary.
18. May other practitioners, besides licensed physicians (M.D.s and D.O.s), provide a medical exemption to a required immunization?
No. Only a licensed Medical Doctor (MD) or Doctor of Osteopathic Medicine (DO) may provide a medical exemption.
In contrast, the other categories of licensed or credentialed practitioners in California previously authorized through 2015 to sign requests for personal beliefs exemptions (e.g., Nurse Practitioner, Physician Assistant, Naturopathic Doctor, or School Nurse) may not provide medical exemptions.
19. Is there a standardized form for medical exemptions?
No, but the documentation must include the elements described in question 17.
20. Are licensed physicians required to assist in requests for medical exemptions?
A licensed physician may provide a medical exemption but is not required to do so. Parents or guardians seeking medical exemptions should check with physicians in advance to clarify their policies on medical exemptions.

Valid data determines Standard of Care in medicine, and vaccine exemption guidelines, if in fact science matters, should begin to reflect such non-industry funded research. Patients will play an important role in bringing this data to the attention of busy physicians who are wither under-motivated or just too busy to fine it themselves. Because data regarding vaccine injury is largely suppressed, we the parents will drive this process.

Thank you for massing this very informative and instructional compilation of information. So grateful to have resources that clear, objective, and not fear based.
Two things: I have a child entering the 5th grade with a on site home study school. I understand that our current PBE waiver continues to cover until 7th grade.
(1) Would you recommend that we get a medical waiver on file now before the climate changes, or before they start making it nearly impossible to do so I the future? Or should we wait until the end of 6th grade to obtain a medical waiver?
(2) Does anyone know of San Diego area based MD or OD that are medical exemption friendly? Any recommendations of San Diego / North County MD or OD that provide medical exemption waiver would be greatly appreciated. Or, if you are a practitioner, please email me your contact info and I will follow up.
Thank you again for everyone’s contributions. I feel less alone I the concern for my child’s medical well being. The ability to force pharmaceutical drugs on children and adults seems very anti-democracy and restrictive of civil liberties to me. Very scary.

Hi Faith-

Faith says
Hi Kim,
I’ll follow up here if I find someone that is choice friendly. Was just listening to a talk radio show about how a group of doctors want the ability to drop families as patients of those that opt not to vaccinate. As if there aren’t serious diseases and other ailments far more threatening to life and limb than a non vaccinated child.
When and how did this even come to be a “thing”. It is personal choice. At least, it was. Forcing children to accept a myriad of drugs into their systems under the guise of prevention feels lcriminal and reminiscent of Hitler.
Hopefully will be able to locate a conscientious MD or OD so that my child can get through the rest of her education without mental and physical altering drugs being mandated into her system. And we wonder why people seem to be using less and less of their critical thinking abilities.

Hello everyone,
I am so very grateful to have found this website and forum – the information that is provided in the article and by other concerned parents, is absolutely priceless to me.
My husband and I, and our two school-aged children, are planning to move from Canada to Orange County in the next year or so. However, I was devastated when SB277 was passed, as neither of my children are vaccinated and we have no intentions of having them vaccinated. As such, we are very concerned about whether or not they will be able to attend a public school in OC, as we would like them to have the “school experience” and are not wanting them to be homeschooled.
I have spoken with like-minded parents in Southern California, who provided me with the name of an MD (he is also named on the list in the article’s link), and advised me that private schools are often more lenient and accepting of medical exemptions, however, the enrolment costs just aren’t feasible for us.
With that being said, I’m wondering if any parents in OC – Dana Point, specifically – can tell me which schools, if any, have accepted their children’s exemption letters? We are intending on moving to/near Dana Point, and would appreciate any information about the school system in the area, that anyone can provide.
Thank you again!

Greetings to everyone! I have 5 children 4 of which are still living @ home My daughter is in 7th grade and i had a belief exemption waiver on file before the January 1st cut off. At the start of 7th grade to a new school they did not honor my form so the grandfather clause is not working for me. the school issued a letter stating that she can not come back, without her shots. she has never been vaccinated due to hyper Immune issues.and I do not intend to give her any shots what so ever, as i am concerned that her body will not take well to the ingredients which include animal & toxic chemicals that are in many of these vaccinations. after carefully reading a lot of material on different websites, i see that the only thing left to do is take a stand with no fear, remain calm and prepare a medical exemption form with the proper language and take it to a doctor. do your best to find some help. there is obviously a hidden agenda that is to keep you in the dark! you must not give up there are loop wholes. Now i’m just waiting for my doctor to get back to me, after requesting her to sign a waiver, so my child can return to school. She did not no what to do so she had to check to see what she can do. i decided while she’s checking i’m going to be pro- active, and put a medical waiver together for her that explains my concerns, in hopes that she will sign it. peace and many blessings to all.

The school in my county in CA didn’t even accept my application with a medical exemption. it has to be submitted to the district for approval, and they ask you for permission to find out the details for exemption, from the doctor, which is not even legal. I’ve been running around, both my kids have had vaccine reactions or after effects from vaccinations in another country but not on records because they were brushed off as normal. Which I now know is totally untrue. Contact an organization that’s fighting for our right to choose. Voice for choice is one of them.
I’ve been desperately searching on the internet, and found something called an advanced vaccine directive, an international law which his effective under unconstitutional circumstances such as this one. It is supposed to be above school rules and the country. I don’t understand legalese, but that’s something you could look up on the internet.

Does anyone here know of any doctors in or around NJ – (PA, NY even Connecticut would do) that would give a medical exemption (I really have basis for one. Just in the area I’m in it’s a hopeless cause. and even though i’m in NJ the school will not accept a religious exemption. – So far, religious exemption is still legally supposed to be accepted in NJ. Let’s hope nothing changes.) If i’m forced to , we may just travel to CA to get one but it sounds a bit crazy. There has to be someone closer to where I am. Just don’t know who they are. Any leads would be greatly appreciated!!!

Hi,
In search for a doctor in Southern CA I.E area. Can anyone give any information for a doctor who I could receive in a vaccine exemption.
Angel says
Yes, me too–Doctor ANYWhere (in California) who will sign waiver–child has documented contraindications –previous Anaphylaxis. please help! All the links in this thread are not working–new links please!
Angel says
If You know Any REAL doctor ANYWHERE in the US who could sign waivers for a 17 year old and a 21 year old who have documented contraindications-Anaphylaxis–! please!!!
Its a witch hunt in California now–so very un-constitutional–blatant corruption.
What happened to the Hippocratic oath?
“Do no Harm”
That physician’s take to protect patients?
I see no evidence of the Hippocratic oath or the United States Constitution in these new vaccine laws designed to enslave, disempower & H A R M CHILDREN. Please Help Us in California!!!
